General Sales Terms and Conditions Ferrari F1 Club Tickets

These terms and conditions are applicable to all sales contracts signed between any Purchaser buying a Ferrari Formula One Club ticket at the online internet store at store.ferrari.com/events (hereafter the "Purchaser") and

(hereafter the "Supplier")

Supplier is appointed by Ferrari S.p.A., Via Abetone Inf. 4, 41053 Maranello (MO), Italy (hereafter "FERRARI") to sell Ferrari Formula One Club tickets (hereafter the "Tickets") on sale at the e-commerce website (internet) at store.ferrari.com/events/ (hereafter the "Website"). When a sales contract is signed, the Website will be used exclusively by the Supplier, whereby it is understood that FERRARI is the sole holder of all rights to the domain, (domain name) , logos, trademarks and copyrights used on the Website and on the products offered on the Website (if any).

The Ferrari F1 Club areas are located at the various circuits as seen below (unless any changes are imposed by circuit management and hence beyond the control of FERRARI and/or of the Supplier). In such cases, the Supplier reserves the right to notify the Purchaser as soon as such information becomes available):

1. Content of the general sales conditions

The following general sales terms and conditions apply to the sale of Tickets by the Supplier to the Purchaser via the Website.
All contracts are regulated by the version of the general sales terms and conditions published on the Website at the time the contract in question is signed (see Art. 3).
The term "Purchaser" refers to any natural or legal person making such purchases for scopes and purposes unrelated to the business activity of the same.
No amendments to the general sales terms and conditions proposed by the Purchaser will be deemed valid unless accepted in writing by the Supplier.

2. Contract sections and geographical area

The Website is destined for use by all parties, whether individuals or companies. All claims related to the Website must be forwarded to the Supplier.
The Tickets on sale at the Website will be delivered to the Purchaser at the address indicated in the relative section on the Website (see Art. 4). If the requested Country is not available when the order is received, please contact Customer Care at the following address: ferrarif1club@ferrari.com.

3. Finalising the contract

All the information on Tickets published on the Website, for instance the date of the events, are subject to change at any time, unless specifically indicated as binding.
The sale of Tickets on the Website is not binding for the Supplier and is not an offer to the public, but simply an 'invitatio ad offerendum' (invite to place an order). The purchase order submitted by the Purchaser represents an irrevocable and binding request. The purchase order will be accepted by the Supplier via an order confirmation sent by e-mail. The order confirmation shall state the applicable sales conditions, information on the event, the main elements of the contract (price, payment method), the compiled order form and the data registration instruments used by the Supplier, along with any correction procedures applicable to the contents of the order.
The Contract will be finalised and come into effect when the Purchaser receives the Order Confirmation.
The order and order confirmation documents will be deemed as received when the interested parties are able to access the electronic messages.
If the Purchaser does not receive confirmation of his order, or any other form of communication from the Supplier within 24 hours from sending his order, the Purchaser should promptly contact the Supplier by e-mail at the following address: ferrarif1club@ferrari.com.

4. Purchasing Tickets

The Purchaser must be registered and have an account on the www.ferrari.com website or on the Website in order to purchase a ticket. After selecting the Ticket, the Purchaser will be required to provide the information needed to prepare the contract before completing the purchase process. In particular, the Purchaser will be required to enter his/her personal data in the relative section on the website, along with an e-mail address, ticket delivery address (where applicable) and a telephone number which may be used to notify the Purchaser of the ticket delivery date.
The Purchaser can pay for the Ticket exclusivity through the use of one of the credit cards available and indicated in the relative section on the Website.
The Supplier reserves the right to check the general information provided by the Purchaser for accounting reasons.

5. Delivery of Tickets

Ticket availability is indicated on the Website. After receiving full payment, tickets will be delivered by courier service to the address indicated by the Purchaser roughly 5 days before the specific event.
If, for whatever reason, Tickets cannot be delivered within the terms indicated above, and full payment has been received, the Purchaser agrees to collect the Tickets on day 1 of the 3 GP event days from the Ferrari Team Hotel reception area, near the circuit; the Purchaser will receive the exact address by e-mail in advance.
When the Purchaser receives the Tickets by courier service, the former agrees to check that the Tickets delivered are correct, and promptly notify any discrepancy in writing to the following e-mail address: ferrarif1club@ferrari.com.

6. Prices and delivery costs

Ticket prices are those indicated on the website the day on which the order is sent, before the actual order is issued.
Any additional despatch and delivery costs shall be borne by the Supplier. 
All costs are listed separately before the order is sent and again on the order confirmation sent by e-mail.
The price paid for each Ticket includes:
• Access to the Ferrari F1 Club
• All day admission to the Open Bar
• Buffet lunch
• Pitwalkabout at specific times
• Individual visits to the Ferrari pit/garage (managed by the Ferrari F1 Club staff)
• Presence of the drivers at the Hospitality area
• Exclusive gifts every day

7. Payments

Purchasers shall pay for their Tickets, within five days from receiving order confirmation from the Supplier, exclusively through the use of one of the credit cards available and displayed on the Website. Card accepted are Visa and Master Card. The Purchaser data is transmitted encrypted through SSL system (Secure Socket Layer) on Banca Sella server that ensures the security of data transmission in accordance with bank procedures. Warning: The account is debited at time of order. 
If the person paying for the Ticket is not the person who will actually attend the event in relation to which he/she buys the Ticket, this information must be provided as soon as possible to the following address to avoid problems of an administrative nature: ferrarif1club@ferrari.com.
Any tax applicable in the country of purchase will be added to the basic Ticket price. The invoice shall be paid within one week from the booking date[MM1] . 
If at least 3 tickets are purchased for the same GP (5 Tickets for the Monaco GP and Singapore GP and 10 Tickets for the Brazil GP), the Purchaser will be entitled to receive one (1) free car park pass.
It is possible to purchase additional car park passes at a cost of Euro 100 + VAT each, subject to availability.
Each Ferrari F1 ticket shall include three coupons which will be valid for one day each and which may be used by different people during the GP week end, but not during the same day. After entry to the Paddock on a particular day, tickets are not transferable for that day.

8. Access restrictions for participants

In accordance with the specific regulations enforced by GP organization committees, 
any person 7 years of age or under is not admitted to the Formula One Paddock Club ™ (hereafter the "Paddock"), where the Ferrari F1 Club is located, even if they are in possession of a Ticket.
Smart casual attire is recommended. No jogging suits or beach wear will be allowed for the person attending the relevant event including any person under 18 years old (but in any event older than 7 years old) unless accompanied by an adult. ASM (as hereinafter defined) reserves the right to refuse or restrict entry to the Paddock, and may request the departure from the Paddock of any person not complying with these terms and conditions. No pets will be allowed within the Paddock.

9. Withdrawal rights

The Purchaser hereby agrees and acknowledges that, in accordance with Art. 55 of the Consumer Rights Code (Legislative Decree n. 206 dated September 6, 2005 et seq.), the withdrawal right is not foreseen for the Purchaser.

10. Cancellation or changes in Event dates

 
Ticket holders agree that should any changes be made to the selected event, (in relation to the date or time of the event), no Ticket refunds or exchanges will be available.
If the event is cancelled by the actual event organisation committee, the Purchaser is entitled to request a refund from the Supplier.
No duplicates will be issued if any Tickets are lost or stolen, damaged, defaced or illegible. The only exception for which the ASM will consider providing a replacement, is if the Purchaser who bought such Ticket is able to inform the Ferrari F1 Club staff about the type and the code number of the Tickets lost, misplaced or stolen. Moreover the Purchaser has to authorise their cancellation and the issuance of new Tickets.
The Ferrari F1 Club shall not be responsible or any way liable for Tickets lost or misplaced in the course of courier delivery and for the Ticket's delivery not accepted from the addressee (private residence, company address or hotel's concierge) indicated from the Purchaser.

 
11. No Advertising or Promotions – No Use of Tickets in Promotions

 
The Purchaser shall not undertake advertising or promotional activity at the Paddock, including, without limitation the displaying of any corporate signage or corporate identification within or outside the Paddock.
The Purchaser shall not use for any advertising, promotional or commercial purposes (including without limitation prizes, competitions, contests or sweepstakes) (in any media) 1) the name of Allsport Management S.A. of World Trade Center I, P.O. Box 51, 1215 Geneva 15, Switzerland its successors and permitted assigns ("ASM") or 2) the name of the relevant round of the 2013 FIA Formula One World Championship™ or part thereof (the "Event") or 3) the name of any other round of the FIA Formula One World Championship™ (or any abbreviation or foreign language version thereof) or 4) any Tickets or 5) the "Formula One Paddock Club™" or the "Paddock Club™" name or logo or 6) the Paddock or do any act or thing to imply or give the impression that 1) his activities are connected to or endorsed by the Formula One Paddock Club™, the Paddock Club™ or ASM or 2) that he is a sponsor of or supplier to the relevant Event or the Paddock or in some other way connected to ASM, that Event or the Paddock.

 
12. Copyright

All contents of the Webiste are protected by copyright. All rights reserved to FERRARI.
It is prohibited to reproduce all or any part of the website contents, transfer any parts using electronic or traditional methods, amend, tag or exploit such contents for public or commercial purposes without express written authorisation from FERRARI in advance.
The Purchaser shall not use any of the expressions "Formula One™", "Formula 1™", "F1™", "FIA Formula One World Championship™", "Formula One Paddock Club™", "Paddock Club™" or any trade marks (whether registered or unregistered) or logo(s) pertaining thereto or any other intellectual property right owned by ASM or by any third party.
The Purchaser shall not use the name of the relevant Event (or the name of any other round of the FIA Formula One World Championship™) or part thereof (nor any abbreviation or foreign language version thereof) nor any logo or graphic device of or relating thereto for any commercial purpose whatsoever. This is a fundamental term.

13. Undersigned Obligations and Acknowledgements

The Purchaser shall comply with all security arrangements and display in a clear and visible manner at all times on entry to and within the relevant Event and the Paddock, the correct Ticket and (if requested by ASM) wear a corresponding wristband at the Event and at all times upon entry to and whilst within the Paddock and in any area of the Event where the Ticket permits access. ASM and/or its representatives reserve the right to refuse entry to the Paddock to the Purchaser or any other person who does not comply with the security arrangements or who is not displaying such Ticket and/or is not wearing such wristband, and ASM reserve the right to refuse service to a person who is not displaying such Ticket and/or is not wearing such wristband within thePaddock.

 The Purchaser shall comply with:

(a) any security arrangements, directions or notices displayed or given by officers, employees or agents of or persons authorised by FIA, FOWC, FOM, ASM or the promoter of the relevant Event including, without limitation, notices, directions or other requirements relating to access and security at that Event, medical matters, evacuation procedures or the conduct at that Event;

(b) the conditions of entry displayed at the entrances to that Event; and

(c) all laws, regulations or requirements of any authorities (including, without limitation, the FIA, FOWC, FOM, Beta Prema (UK) Limited ("BPR") and the promoter of the relevant Event) having jurisdiction over the activities of ASM, the Event and/or the use or occupancy of the Paddock.
The Purchaser who is under 18 years of age is accompanied and supervised at all times by his or her parent or guardian who must also hold a Ticket. Notwithstanding the foregoing, ASM reserves the right not to admit to the Paddock at any Event (or sell Tickets for use by) any person seven (7) years of age or under.

The Purchaser shall be responsible for and shall indemnify Ferrari and ASM against any loss (including any indirect loss, consequential loss or loss of profit), damage, injury, costs or expenses arising out of any act or omission at or in connection with the relevant Event or arising out of any failure to comply with these terms and conditions save for death or personal injury caused by ASM's negligence.
The Purchaser acknowledges and accepts that motor racing, the relevant Event and certain activities associated therewith (including, without limitation, support races and support events and activities) are dangerous and that some personal risk may be involved in attending the Event and therefore attendance is entirely at his own risk

The Purchaser, to all possible extent as permitted by law:

i) excludes, releases and forever discharges ASM, FIA, FOWC, FOM, the sporting Organiser, (the relevant national sporting authority), the promoter of the relevant Event, Formula One Licensing B.V., Formula One Asset Management Limited, BPR, FERRARI and any other persons or organisations involved in the organisation, conduct and promotion of the Event (the "Indemnified Parties") from all liability for claims, loss (including any indirect loss, consequential loss or loss of profit), damage, injury, costs or expenses (whether arising under statute, from negligence, personal injury, death, loss or damage to property, infringement of third party rights or otherwise) arising from or connected with the Event including without limitation any occurrence of fire or theft; and
ii) indemnifies and agrees to keep indemnified each of the Indemnified Parties against any such claims, loss (including any indirect loss, consequential loss or loss of profit), damage, costs or expenses brought by, or arising from any act or omission, save that nothing in these conditions limits or excludes (a) liability for death or personal injury arising out of the negligence of any of the Indemnified Parties or (b) any damage incurred by way of fraud or fraudulent misrepresentation by any of the Indemnified Parties.
ASM reserves the right in its discretion not to allow personal electronic devices to be taken into or used at or within the Paddock or during any pit walkabout;

People with a pacemaker should contact security officials for assistance before approaching the electronic Paddock gates.
For reasons of security and safety, ASM reserves the right in its discretion:
(a) to refuse suitcases, bags, electronic equipment, food, beverages and/or other items being brought in to the Paddock (or in to any area under the control of ASM) whether before, during or after the relevant Event; and
(b) to inspect any bag or other item which any person wishes to bring in to or remove from the Paddock, whether before, during or after the relevant Event.

ASM (or any person operating the Paddock or any aspect of the Paddock for ASM) may refuse entry to the Paddock to the Purchaser where ASM (or such person) regards it as necessary or appropriate to do so on grounds of health, safety, security or public order or where ASM or such person believes that the admission of the Purchaser would be materially prejudicial to any other person's enjoyment of the Paddck.

The Purchaser shall not sell, offer to sell, on-sell, exchange for fee, reward or other valuable consideration, assign, sublet, encumber, licence, sub-licence, transfer, dispose of or otherwise deal with any of the rights, benefits or obligations contained in these terms and conditions nor sell or offer to sell any Ticket(s) to a third party without first obtaining the prior written consent of ASM which consent shall be exercisable in its absolute discretion and which may include such conditions as ASM thinks fit. This is a fundamental condition.

 
14. Governing Law

14.1. Ticket purchase terms and conditions are governed by Italian law.
14.2. All disputes arising pursuant to these "General sales terms and conditions" shall be the exclusive jurisdiction of the Italian Court of Law, in accordance with the Consumer Code (Legislative Decree n. 206 dated September 6, 2005). All professional business disputes between the parties will be the exclusive jurisdiction of the Court of Milan.

15. Conclusive clauses

If any clauses in these general sales terms and conditions are found to be invalid, or subsequently become invalid, this will have no impact on the other clauses in the general sales terms and conditions or purchase contract; the invalid clause shall be replaced by a valid clause whose content reflects as far as possible the original intent and economic purposes of both parties or following specific legal agreements.
The Supplier reserves the right to amend all or part of these general sales terms and conditions at any moment in time.

The event programme and dates may be subject to change by the organisers due to organisational, technical or other reasons which are not foreseeable and hence beyond the control of the Supplier; in these cases no Ticket refunds or exchanges will be available to the Purchaser.

16. Security

All possible precautions have been taken to protect user date against loss, destruction, falsification, manipulation and improper use by third parties.
