These General Terms and Conditions of Sale, together with the Terms of Use, Return Policy, and Privacy Policy, govern the offer and sale of products on www.store.Ferrari.com. The seller (the ‘Seller’) of the products displayed on the Site is Level S.r.l. (The Seller"), with a registered office at Piazza Arcole 4, 20143, Milano, MI, Italy P.IVA 12627050961.

1. OUR COMPANY POLICY

1.1 The Seller offers products for sale on www.store.Ferrari.com and its e-commerce business services are available exclusively to its end users, referred to as "Consumers" or "Customers". 1.2 For the purposes of these Terms and Conditions of Sale, "Consumer" means any person who acts on www.store.Ferrari.com for purposes outside their commercial, entrepreneurial, or professional activity. If you are not a Consumer, please do not purchase products on.

1.3 The Seller reserves the right to not process orders received from users who are not "Consumers" and any other order that does not comply with the Seller's commercial policy. The Seller reserves the right to limit, at any time, the quantity and/or type of Products that can be purchased on the Website. The style, models, and colors of the Products described on the Website may be modified without notice. During the purchase procedure, if the order cannot be fulfilled due to the unavailability of the ordered Product, the Consumer will be notified by an automatic message. The Seller is not liable to the Consumer in case of unavailability of a Product if this occurs before the conclusion of the contract.

1.4 These Terms and Conditions of Sale govern the offer, transmission, and acceptance of purchase orders for products on www.store.Ferrari.com between the users of www.store.Ferrari.com and the Seller.

1.5 These Terms and Conditions of Sale do not govern the provision of services or the sale of products by third parties present on www.store.Ferrari. hrough links, banners, or other hypertext links. Before placing orders and purchasing products and services from third parties, it is recommended to check their terms of sale; the Seller cannot in any way be held responsible for the provision of services provided by third parties or the execution of e-commerce transactions between users of www.store.Ferrari.com and third parties.

1.6 The Products available on the Website represent a selection of the items normally available in stores; however, the Seller does not guarantee to the Consumer that the Products available on the Website are also present in stores or vice versa. The graphic representation of the Products displayed on the Website may be different from reality; the Consumer must therefore rely exclusively on the description of the Product and its characteristics as reported on the Website.

1.7. With the user's consent to profiling for marketing activities as indicated in the privacy policy, the user can benefit from a personalized experience and tailored support on the website. This may include personalized product recommendations, style advice, and specific offers based on the user's preferences and purchase history.

2. HOW TO PLACE AN ORDER WITH THE SELLER

2.1 To place an order for the purchase of one or more products on www.store.Ferrari.com it is necessary to complete the online order form and send it to the Seller electronically, following the instructions provided. The transmission of the order proposal constitutes a purchase proposal for the selected Products, governed by these Terms and Conditions of Sale and binding on the Consumer, without prejudice to the right of withdrawal provided for in Article 7 below. The transmission of the order proposal by the Consumer implies the obligation of the latter to pay the price of the Products ordered. The information present on the Website does not constitute an offer by the Seller.

2.2 The order form contains a summary of these Terms and Conditions of Sale and the Return Policy, information on the main characteristics of each product ordered and the relative unit price (including all applicable taxes and duties), the type of payment method for the purchase of each product, the shipping conditions of the products purchased, the shipping and delivery costs, and the return conditions for the products purchased.

2.3 The order is considered transmitted when the Seller receives the order form in electronic format and the order information has been verified as correct.

2.4 Before submitting the order form for the purchase of the products, the user will be asked to carefully read the return policy, print a copy using the print option, and save or reproduce a copy for personal use.

2.5 The order form will be archived in our database for the time necessary to fulfill the order and as required by law. It is possible to access your order form by logging in and visiting the section called Orders, in the My Account area.

2.6 After the order form has been submitted, the Seller will process the order.

2.7 The Seller may refuse to process purchase orders if there are insufficient guarantees of solvency, if the orders are incomplete or incorrect, or if the products are no longer available. In the cases mentioned above, the user is informed by email of the non-acceptance and non-fulfillment of the purchase order by the Seller, specifying the reasons. If the products displayed on www.store.Ferrari.com are no longer available at the time of the user's last access to the website or submission of the order form, the Seller will inform the user of the unavailability of the products ordered within thirty (30) days from the day following the receipt of the order. If the order form has been submitted and the product has already been paid for, the Seller will refund the amount paid for such items. 2.8 With the electronic transmission of the order form, the user unconditionally accepts and undertakes to observe these Terms and Conditions of Sale. If you do not agree with certain provisions of these Terms and Conditions of Sale, please do not submit the order form for the purchase of products on www.store.Ferrari.com.

2.9 With the transmission of the order form, the user agrees to and accepts these Terms and Conditions of Sale, as well as any further conditions contained on www.store.Ferrari.com, including by link, including the Terms of Use and Privacy Policy of www.store.Ferrari.com.

2.10 Upon transmission of the order form, the Seller will send the user, by email, an acknowledgment of the purchase order, containing a summary of the information relating to the order form (Terms and Conditions of Sale, main characteristics of the products, detailed price information, payment method, return terms and shipping costs).

3. WARRANTY AND PRODUCT PRICE INFORMATION 

3.1 www.store.Ferrari. offers only products purchased directly from the Seller by Ferrari S.p.A. - a single-member company with registered office Via Emilia Est 1163, Box 589, 41122 Modena, Italia, P. IVA e C.F. 00159560366; - and/or their authorized manufacturers and bearing the trademarks owned by Ferrari S.p.A. or which it has been authorized to use. 

3.2 The Seller does not sell second-hand, defective, or substandard products. 

3.3 The main characteristics of the products are described on su www.store.Ferrari.com on each product page. The images and colors of the products for sale on su www.store.Ferrari.com may not correspond exactly to the real products, due to the Internet browser or monitor used. 

3.4 The price of the Products indicated on the Website is expressed in Euros and/or in any local currencies when available and is inclusive of all applicable taxes or duties, with the exception of countries where taxes are applied at checkout (i.e., Canada, United Kingdom, Japan, USA, Australia, Taiwan) and markets served in Delivery Duty Unpaid (Incoterm 2020). Any delivery costs will be added to the price of the Products and will be indicated separately in the order form, if applicable. Prices are subject to change. The final sale price must therefore be verified before submitting the relevant order form. 

3.5 Orders received from countries other than those selected for shipping or to addresses to which the Seller cannot ship cannot be accepted. 

3.6 All products sold on the Website are equipped with an identification tag applied with a single-use seal. In the event that you wish to exercise your right to return the products, the tag and/or seal must not be removed, as they are an integral part of the purchased products. 

3.7 If the user decides to exercise the right to return the products, the Seller may refuse to accept products that are damaged, do not have the tag or seal, or whose main characteristics or quality have been altered. 

3.8 The Seller does not guarantee the accuracy of the prices indicated on the Website. In the event of an error in the indication of the price of a Product, the Seller will reject the order and offer the Customer the opportunity to purchase the Product at the correct price. If the error is discovered only after the order has been accepted, the Seller will offer the Customer the possibility of canceling the order. 

4. PAYMENT 

4.1 Payment for the products and related shipping and delivery costs must be made using one of the methods indicated in the order form. 

4.2 If you choose to pay by credit card, all financial data (credit/debit card number, expiration date, etc.) is transmitted to an external Payment Service Provider (PSP) that guarantees the security of online transactions using a 256-bit DigiCert SSL SHA2 encryption protocol. The user's financial data will be used by the Seller solely and exclusively for the execution of the purchase procedure, for the issuance of refunds in case of return (in accordance with the rules on the right of withdrawal), or for reporting cases of fraud on www.store.ferrari.com to the police. The price for the purchase of the products and the shipping and delivery costs, as indicated in the order form, will be charged to the user's current account only at the time of actual shipment of the purchased products. 

4.3 In the event that, for any reason, within the period specified in Article 4.2 above, it is not possible to charge the amounts due from the Customer to the credit card (or, in the case of a bank transfer, the funds corresponding to such amounts are not credited to the Seller's bank account), it will not be possible to execute the contract and the order will be considered canceled. 

4.4 For each order, the Seller will issue a specific invoice that will be sent to the Customer via email or by mail in compliance with current regulations. The invoice will be issued on the basis of the information provided by the Customer at the time of the order. No changes to the invoice are allowed after its issuance. 

5. SHIPPING & DELIVERY OF PRODUCTS 

5.1. For information on specific shipping and delivery procedures for products, please visit the Customer Service area. Please read these sections carefully. The information provided forms an integral part of these Terms and Conditions of Sale and, therefore, is considered to have been read and accepted in full by the user at the time of transmission of the order form. 

5.2 Delivery Options 

You can choose from the following options for delivery of the Products as indicated on the checkout page 

  1. Courier 

  2. Store Pickup 

5.3. For the Courier option, delivery will be made by a courier selected by the Seller on working days. The Products will be delivered to the address indicated by the Customer in the order form. Deliveries cannot be made to PO boxes. 

5.4 The Seller will send the Customer a confirmation email of shipment after the Products have been shipped, as well as a second email confirming delivery sent directly by the courier responsible for the shipment. 

Except in the event of force majeure or unforeseen circumstances, deliveries will be made within 30 (thirty) days from the date indicated in the order confirmation. In the event of non-delivery within the aforementioned period, the Customer may terminate the contract and the Seller shall reimburse without delay all expenses incurred. 

5.5 For Store Pickup, delivery can be made at Ferrari Stores that adhere to the service and are indicated on the Website. In the event of using this pickup method, the Customer or the person to whom the payment method is registered, must bring with them: 

  • a valid identity document; and

  • a copy (digital or paper) of the confirmation email that the Products are available for pickup. 

If the Customer has instructed any other person to collect the order, it is important that they have with them: 

  • a copy of the Customer's identity document; 

  • a valid identity document of their own;

  • a copy (digital or paper) of the confirmation email that the Products are available for pickup; and 

  • a completed and signed authorization from the Customer who made the purchase. 

5.6 The Products will be kept in Store for 15 (fifteen) days from the receipt of the confirmation email that the Products are available for pickup. After this period, if the Products have not been collected, the order will be automatically canceled and a refund will be made according to the procedure provided.  

5BIS. PRE-ORDER PRODUCTS 

5bis.1 In some cases, the Seller may offer you the possibility to pre-order one or more items that are not yet available for purchase on Ferrari Store. Products available for pre-order will be marked with a special label on the product page. The Seller will indicate for each item the estimated shipping date and will in any case send you a confirmation email when the package is shipped. In the event that your purchase order contains both items already available and items on pre-order, the products will be shipped at two different times, but the shipping costs will be charged once only. In the case of a purchase order that contains only pre-order items but with different shipping dates, the products will all be shipped together on the last estimated shipping date. 

5bis.2 Please note that pre-order products can only be purchased with a credit card.

5bis.3 Except as otherwise provided in this paragraph 9, the General Terms and Conditions of Sale apply in full to products purchased on pre-order.    6. CUSTOMER SERVICE

7. RIGHT OF WITHDRAWAL AND PRODUCT REPLACEMENT 

7.1 In accordance with Article 54 of the Italian Consumer Code, the user may withdraw from the contract with the Seller, without any penalty and without specifying the reason, up to fourteen (14) working days from the date of receipt of the products purchased on www.store.Ferrari.com or, from the date of collection of the order at the Ferrari store if the purchase was completed with the "Store Pickup" delivery option. 

In some cases, the user will have the possibility of exchanging the purchased products for others of the same model with different size and/or color, provided they are of equal value. The exchange of products will only be possible if the products in the selected size and/or color are available in the Seller's warehouses. The user may request the exchange of the purchased products without any penalty and without specifying the reason, up to fourteen (14) working days from the date of receipt of the products purchased on www.store.Ferrari.com or, from the date of collection of the order at the Ferrari store if the purchase was completed with the "Store Pickup" delivery option. 

The request must be sent to the Seller by filling out the Return Authorization Request available on the website in the Customer Service area, within the specified period. The products subject to the exchange request must be returned to the Seller in their original packaging, unused, not worn, washed or damaged, and the identification tag must still be attached with the single-use seal.

9. GOVERNING LAW AND DISPUTES 

These Terms of Sale and any non-contractual obligations arising out of or in relation to the Terms of Sale shall be governed by and will be interpreted in accordance with Italian laws.

The Seller undertakes to meet the needs of users, as far as possible, and to resolve any disputes amicably.

10. CHANGES AND UPDATES

These Terms of Sale may be modified from time to time due to the entry into force of new laws and regulations or for other reasons. The new Terms of Sale will come into effect from the date of publication on www.store.Ferrari.com.

RETURN POLICY 

We are committed to ensuring your complete satisfaction with your purchase. If, for any reason, you are not satisfied with your order, you may exercise your right to return the purchased products within fourteen (14) working days from the date of receipt from da www.store.Ferrari.com. Returned items must be shipped back to the Seller within fourteen (14) working days from the date of package delivery. Products can be returned by sending the package through the courier indicated by the Seller or another courier. We encourage our users to complete the Return Authorization Request available on the website in the Customer Service area to allow us to provide them with a Return Authorization Number. Exchanging an item for another is not permitted, except in the case provided for in Article 7.1. 

1. RETURNS POLICY 

The right to return products is considered correctly exercised once the following conditions have been fully met: 

A. The online return authorization request to the Seller has been correctly completed and submitted within fourteen (14) working days from the date of receipt of the goods; 

B. The products have not been used, worn, washed, altered, or damaged; 

C. The identification tag is still attached to the products with the single-use seal; 

D. The products are returned in their original packaging; 

E. The returned products must be shipped back to the Seller within fourteen (14) working days from the date of package delivery. 

If all of the above requirements are met, the Seller will refund the full price of the purchased products. If the user decides to use the courier indicated by www.store.Ferrari.com in the online return authorization request, they will not have to deal directly with the return shipping costs, which will be charged to the user themselves. Notwithstanding the foregoing, the Seller reserves the right to handle the return shipping costs directly and therefore not to charge them to the user. 

In such cases, www.store.Ferrari.com will cover the return shipping costs, which will then be deducted from the user's refund amount. This is subject to the condition that the Seller has expressly exempted the user from these costs at the time of purchase and the additional condition that the user utilizes the shipper and shipping methods suggested by the Seller. If the returned products cannot be accepted, the user will be notified accordingly. In this scenario, the user may choose to have the products redelivered at no cost to the Seller. Should the user refuse this redelivery, the Seller reserves the right to retain the products and the amount paid for their purchase. 

If you choose to return the products directly to a Ferrari store listed on the Website, without waiting for the courier to arrive at your home address, you will not incur any costs and will not need to fill out the online return form. Simply hand over the products, the original packaging, the pre-printed adhesive label, and the order summary letter to a Ferrari Store sales assistant within fourteen (14) days of receiving the products. 

The sales assistant will check for the presence of the identification tag on the products and will also verify that the products are free from visible defects and/or flaws that make them unusable. 

If, upon preliminary inspection by the sales assistant, it is determined that the products have visible defects and/or flaws, the sales assistant will not be able to accept the products and will ask you to contact the Seller's Customer Service directly. 

If, upon the aforementioned inspection, it is determined that the products are free from visible defects and/or flaws, the sales assistant will complete the return form, collect the products, and place them in the original packaging, applying the pre-printed adhesive label to allow for shipment to the Seller.    Please note that the sales assistant only performs a preliminary check of the products and that the acceptance of the products in the store does not equate to acceptance of the return by the Seller. The Seller will verify the conformity of the products to the conditions and terms mentioned above as soon as it receives the products at its warehouses and will inform you via email in case of acceptance of the return. 

Notwithstanding the aforementioned acceptance of returns, if the user has paid for the order by cash on delivery and wishes to receive the refund directly into their bank account, they must bring their IBAN code to the selected store and communicate it to the sales assistant for inclusion in their customer profile.   

2. REFUND TIMING AND PROCEDURES 

Once the Seller has received the returned products and verified that they meet all requirements, the user will receive an email confirming the acceptance of the returned products. Regardless of the payment method used by the user (Credit/Debit Card, Cash on Delivery), the refund procedure will start within thirty (30) days from the time the Seller is informed of the decision to exercise the right to return the purchased products and once the Seller has verified that the return has been made in compliance with the conditions mentioned above. The time required to refund the amount paid for the purchase of the returned products depends on the type of payment used: 

A. Purchase with credit/debit card: The time required for the refund depends on the policies of the credit card company. In any case, we guarantee to users that the credit value date will coincide with the date of the original payment, without any loss of interest for the user. 

B. Cash on Delivery payment: The amount paid for the returned products will be refunded to the bank account indicated by the user in the Return Authorization Request; the time required for the refund depends on the information provided in the order; normally refunds are made within one month. Please note that a bank account is required to receive a refund for cash on delivery orders. 

C. Payment via Digital Payment System (e.g., PayPal, Amazon Pay, Apple Pay, Alipay, Klarna): The amount will be credited back to the original payment method, such as the user's PayPal account. The time required for the refund depends on the policies of the company that manages these payment systems.
